Filmdokument: Kriegsverbrecher-Prozeß in Görlitz

Erstmals habe ich historisches Filmaterial über das Verfahren gegen die zwei „Hauptschuldigen NS-Verbrecher“ in Görlitz gefunden. Ich meine den im Volksmund bekannten Malitz-Meinshausen-Prozeß gegen Dr. Bruno Erwin Fritz Malitz, so der vollständige Name des ehemaligen NSDAP-Kreisleiters in Görlitz, und gegen den ehemaligen Görlitzer Oberbürgermeister Dr. Hans Friedrich August Meinshausen.
Malitz und Meinshausen waren zwei von insgesamt 2405 sogenannten Hauptschuldigen NS-Verbrechern, gegen die in der Sowjetischen Besatzungszone zwischen September 1947 und Jahresende 1950 ermittelt wurde.

Aufmerksamkeit erregte der Prozeß nicht nur in Görlitz, sondern dank einer weitreichenden Medienkampagne auch in der gesamten sowjetischen Besatzungszone. Der 2000 Menschen fassende Saal der Görlitzer Stadthalle diente als Verhandlungsort und genügte kaum dem Andrang der interessierten Bevölkerung. Spätestens beim Auftritt von Walter Ulbricht als Zeugen, wird klar, daß es sich hierbei um einen Schauprozess handelt, dessen Urteil, um einer öffentlichen und vor allem deutschlandweiten Blamage zu entgehen, schon von vorn herein festgestanden haben muss. Der Prozeß an sich diente also dazu, die Begründung der Strafe an die Öffentlichkeit zu bringen.

Die beiden Angeklagten werden zum Tode verurteilt. „Das Strafmaß für Meinshausen sei im Verhältnis zu Urteilen des Nürnberger Militärgerichts nicht gerechtfertigt“, hieß es im Revisionsantrag der Verteidigung. Die Ankläger, unter der Leitung von Generalstaatsanwalt Dr. Helm, definierten daraufhin ihre Auslegung der „Verbrechen gegen die Menschlichkeit“, wonach ebendiese sich nicht allein auf körperliche Mißhandlung beschränken, sondern „die gesamte Tätigkeit des Nationalsozialismus auf allen Lebensgebieten“ einbeziehen. Eben diese Tätigkeit stand in Bezug auf das KZ-Außenlager jedoch in Abhängigkeit mehrerer Instanzen, welche man zur Klärung der Verantwortung für den Todesmarsch hätte heranziehen müssen. Die Staatsanwaltschaft bemühte sich nicht, eine Auslieferung des Lagerkommandanten oder des Generaldirektors der WUMAG zu erwirken. Malitz und Meinshausen wurde die gesamte Verantwortung zugeschrieben, so daß sich weitere Ermittlungen, in der hier betreffenden Sache, erübrigten.

Hinter den Personen liegen mehrer stark verweste Skelette.

00:47 – Auf einer der vorderen Bänke, in der als Gerichtssaal dienenden Görlitzer Stadthalle, sind drei Herren zu sehen, die wahrscheinlich als Zeugen geladen waren. Jener Herr mit Krücken ist vermutlich Janusch Oborowicz – ein ehemaliger Häftling des KZ-AL Görlitz.
